1.3    "Sec. 2. [256.0122] STATE SUBSIDY FOR COBRA PREMIUMS.
1.4The commissioner of human services shall provide to each assistance eligible
1.5individual who is eligible for premium assistance for COBRA benefits under the American
1.6Recovery and Reinvestment Act (ARRA) of 2009, Title III, section 3001, with a state
1.7premium subsidy equal to an additional 25 percent of the total premium for COBRA
1.8continuation coverage. The assistance eligible individual's share of 35 percent of the
1.9premium for continuation coverage shall be proportionately reduced. The commissioner
1.10shall pay the state premium subsidy to the entity to whom the assistance eligible individual
1.11is required to pay COBRA premiums, on or before the dates the assistance eligible
1.12individual's COBRA premiums are due. The state premium subsidy must be paid for the
1.13period during which an assistance eligible individual receives the 65 percent premium
1.14subsidy under the ARRA. Employers subject to federal or state continuation law must
1.15provide assistance eligible individuals with notice of the additional state subsidy, in
1.16addition to any other notice required under the ARRA. This section expires December
1.1731, 2010.
1.18EFFECTIVE DATE.This section is effective retroactive to February 17, 2009."
