1.3    "Section 1. [256.0122] SIMPLIFICATION OF ENROLLMENT AND RENEWAL
1.4PROCEDURES.
1.5    Subdivision 1. Preprinted forms for renewals. For children enrolled in medical
1.6assistance or MinnesotaCare, the commissioner shall develop a preprinted renewal form
1.7that contains the child's income information available to the commissioner. This form
1.8must be mailed to the parent of the child prior to the child's renewal date, along with a
1.9notice to the parent that eligibility of the child for medical assistance or MinnesotaCare
1.10shall be renewed based on the information contained in the form. The parent must review
1.11the information and if the information is no longer accurate, indicate this on the form
1.12and return the form to the commissioner with the current information. If the form is not
1.13returned, the commissioner shall determine eligibility for the child based on information on
1.14the form. Nothing in this subdivision shall be construed as prohibiting the commissioner
1.15from verifying income through electronic or other means. If the commissioner determines
1.16that the child is no longer eligible, the commissioner shall disenroll the child.
1.17    Subd. 2. Continuous eligibility. Children under the age of 19 who, at the
1.18time of application or renewal, meet the eligibility criteria for medical assistance or
1.19MinnesotaCare, shall be continuously eligible for the program for 12 months or until the
1.20child reaches age 19, whichever is earlier.
1.21    Subd. 3. Open enrollment and streamlined application and enrollment
1.22process. (a) The commissioner and local agencies working in partnership must develop a
1.23streamlined and efficient application and enrollment process for medical assistance and
1.24MinnesotaCare enrollees that meets the criteria specified in this subdivision.
1.25(b) The commissioners of human services and education shall provide
1.26recommendations to the legislature by January 15, 2010, on the creation of an open
2.1enrollment process for medical assistance and MinnesotaCare that is tied to the public
2.2education system, including prekindergarten programs. The recommendations must:
2.3(1) be developed in consultation with medical assistance and MinnesotaCare
2.4enrollees and representatives from organizations that advocate on behalf of children and
2.5families, low-income persons and minority populations, counties, school administrators
2.6and nurses, health plans, and health care providers;
2.7(2) be based on enrollment and renewal procedures best practices, including
2.8express-lane eligibility as required under subdivision 4;
2.9(3) simplify the enrollment and renewal processes wherever possible; and
2.10(4) establish a process to:
2.11(i) disseminate information on medical assistance and MinnesotaCare to all children
2.12in the public education system, including prekindergarten programs; and
2.13(ii) enroll children and other household members who are eligible.
2.14The commissioners of human services and education shall implement an open
2.15enrollment process by August 1, 2010, to be effective beginning with the 2010-2011
2.16school year.
2.17(c) The commissioner and local agencies shall develop an online application process
2.18for medical assistance and MinnesotaCare.
2.19(d) The commissioner shall develop an application that is easily understandable
2.20and does not exceed four pages in length.
2.21(e) The commissioner of human services shall present to the legislature, by January
2.2215, 2010, an implementation plan for the open enrollment period and online application
2.23process.
2.24    Subd. 4. Express lane eligibility. (a) Children who complete an application
2.25for educational benefits and indicate an interest in enrolling in medical assistance or
2.26MinnesotaCare on the application form shall have the form considered an application
2.27for those programs.
2.28(b) The commissioner of education shall modify the application for educational
2.29benefits to:
2.30(1) include a separate section for medical assistance and MinnesotaCare;
2.31(2) include a check-box to allow all of the children included on the application for
2.32educational benefits to apply for medical assistance and MinnesotaCare; and
2.33(3) specify that if this application box is checked, the information on the application
2.34will be shared with the commissioner of human services.
3.1(c) The commissioner of human services shall match the children's Social Security
3.2numbers with the Social Security Administration database to comply with federal
3.3citizenship documentation requirements.
3.4(d) The commissioner of education shall forward electronically the information for
3.5families who apply for medical assistance or MinnesotaCare to the commissioner of
3.6human services within five business days of determining an applicant's eligibility for the
3.7free and reduced price school lunch program.
3.8(e) The commissioner of human services shall accept the income determination
3.9made by the commissioner of education in administering the free and reduced-price school
3.10lunch program as proof of income for medical assistance and MinnesotaCare eligibility
3.11until renewal. Within 30 days of receipt of information provided by the commissioner of
3.12education under paragraph (d), the commissioner of human services shall:
3.13(1) enroll all eligible children in the medical assistance or MinnesotaCare programs;
3.14and
3.15(2) provide information about medical assistance and MinnesotaCare to other
3.16household members.
3.17The date of application for the medical assistance and MinnesotaCare programs is
3.18the date on the signed application for educational benefits.

3.19    Sec. 2. Minnesota Statutes 2008, section 256.962, subdivision 2, is amended to read:
3.20    Subd. 2. Outreach grants. (a) The commissioner shall award grants to public and
3.21private organizations, regional collaboratives, and regional health care outreach centers
3.22for outreach activities, including, but not limited to:
3.23    (1) providing information, applications, and assistance in obtaining coverage
3.24through Minnesota public health care programs;
3.25    (2) collaborating with public and private entities such as hospitals, providers, health
3.26plans, legal aid offices, pharmacies, insurance agencies, and faith-based organizations to
3.27develop outreach activities and partnerships to ensure the distribution of information
3.28and applications and provide assistance in obtaining coverage through Minnesota health
3.29care programs; and
3.30    (3) providing or collaborating with public and private entities to provide multilingual
3.31and culturally specific information and assistance to applicants in areas of high
3.32uninsurance in the state or populations with high rates of uninsurance; and
3.33(4) targeting families with incomes below 200 percent of the federal poverty
3.34guidelines or who belong to underserved populations.
4.1    (b) The commissioner shall ensure that all outreach materials are available in
4.2languages other than English.
4.3    (c) The commissioner shall establish an outreach trainer program to provide
4.4training to designated individuals from the community and public and private entities on
4.5application assistance in order for these individuals to provide training to others in the
4.6community on an as-needed basis."
