1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. APPROPRIATION; LIVESTOCK AND CROP DEPREDATION
1.4PAYMENTS.
1.5(a) $50,000 is appropriated in fiscal year 2009, $250,000 is appropriated in fiscal
1.6year 2010, and $250,000 is appropriated in fiscal year 2011 from the general fund to the
1.7commissioner of agriculture for compensation payments. In each of fiscal years 2010
1.8and 2011, $125,000 is for crop damage caused by elk under Minnesota Statutes, section
1.93.7371, and $125,000 is for compensation payments for livestock destroyed or crippled by
1.10gray wolves under Minnesota Statutes, section 3.737. The appropriations for fiscal years
1.112010 and 2011 are not added to the base but become the new base funding level.
1.12(b) If the commissioner determines that claims made under Minnesota Statutes,
1.13sections 3.737 or 3.7371 are unusually high, the commissioner may transfer amounts
1.14appropriated for either program to the appropriation for the other program."
