1.5 Subdivision 1.
Warranties by vendors. In every sale of a completed dwelling, and
1.6in every contract for the sale of a dwelling to be completed, the vendor shall warrant
1.7to the vendee that:
1.8(a) during the one-year period from and after the warranty date the dwelling shall
1.9be free from defects caused by faulty workmanship and defective materials due to
1.10noncompliance with building standards;
1.11(b) during the two-year period from and after the warranty date, the dwelling shall be
1.12free from defects caused by faulty installation of plumbing, electrical, heating, and cooling
1.13systems due to noncompliance with building standards; and
1.14(c) during the ten-year period from and after the warranty date, the dwelling shall be
1.15free from major construction defects due to noncompliance with building standards.
1.16The vendor must provide the vendee an option to extend a warranty provided by
1.17paragraphs (a) or (b) of this subdivision to a three-year period. If a vendee chooses to
1.18extend a warranty as permitted by this subdivision, the vendor may require the vendee
1.19to pay an additional fee for the extension.
1.20 Sec. 2. Minnesota Statutes 2008, section 327A.02, subdivision 3, is amended to read:
1.21 Subd. 3.
Home improvement warranties. (a) In a sale or in a contract for the
1.22sale of home improvement work involving major structural changes or additions to a
1.23residential building, the home improvement contractor shall warrant to the owner that:
1.24(1) during the one-year period from and after the warranty date the home
1.25improvement shall be free from defects caused by faulty workmanship and defective
1.26materials due to noncompliance with building standards; and
2.1(2) during the ten-year period from and after the warranty date the home
2.2improvement shall be free from major construction defects due to noncompliance with
2.3building standards.
2.4(b) In a sale or in a contract for the sale of home improvement work involving the
2.5installation of plumbing, electrical, heating or cooling systems, the home improvement
2.6contractor shall warrant to the owner that, during the two-year period from and after the
2.7warranty date, the home improvement shall be free from defects caused by the faulty
2.8installation of the system or systems due to noncompliance with building standards.
2.9(c) In a sale or in a contract for the sale of any home improvement work not covered
2.10by paragraph (a) or (b), the home improvement contractor shall warrant to the owner that,
2.11during the one-year period from and after the warranty date, the home improvement
2.12shall be free from defects caused by faulty workmanship or defective materials due to
2.13noncompliance with building standards.
2.14(d) The home improvement contractor must provide the owner an option to extend
2.15a one or two-year warranty period provided by this subdivision to a three-year period.
2.16If an owner chooses to extend a warranty as permitted by this paragraph, the home
2.17improvement contractor may require the owner to pay an additional fee for the extension."
