1.2Delete everything after the enacting clause and insert:
1.3 "Section 1. Minnesota Statutes 2008, section 134.45, is amended by adding a
1.4subdivision to read:
1.5 Subd. 8. Sale of a public library funded with state bond funds. If the
1.6commissioner of education and the local or regional governmental entity that owns
1.7a public library that has been improved with state bond proceeds under this section
1.8determines that the library is no longer useable or needed for the purposes for which
1.9the grant of state bond funds was made, the owner of the public library may sell the
1.10property in the manner authorized by law for the sale of other property owned by that
1.11jurisdiction for its fair market value. The sale must be approved by the commissioner of
1.12finance. Notwithstanding section 16A.695, subdivision 3, clause 2, the net proceeds must
1.13be applied as follows: first, to pay the state the amount of state bond proceeds used to
1.14acquire or better the property; and second, any remaining amount is appropriated to the
1.15local or regional governmental owner of the property sold. When the sale is complete and
1.16the sale proceeds are applied as provided in this subdivision, section 16A.695 no longer
1.17applies to the property and the property is no longer state bond financed property.
1.18EFFECTIVE DATE.This section is effective the day following final enactment
1.19and applies to the sale of public library property on or after that date."
1.20Amend the title accordingly
