1.3Page 2, after line 29, insert:
1.4 "Sec. 3.
[216B.1613] STANDARDIZED C-BED CONTRACT.
1.5Within 60 days of the effective date of this section, the commission shall initiate
1.6a proceeding to standardize all contract provisions, except those establishing the power
1.7purchase price, for two classes of C-BED projects:
1.8(1) projects with a nameplate capacity of five megawatts or less; and
1.9(2) projects with a nameplate capacity of greater than five megawatts.
1.10The proceeding shall provide for participation by the public and stakeholders. The
1.11commission shall issue an order containing standardized contract language for each class
1.12of C-BED project identified in this subdivision no later than 90 days after the opening of
1.13the proceeding. The standardized contract form shall be similar in all material respects to
1.14the standard contract form previously filed with the commission under section 216B.2423,
1.15subdivision 3, including any revisions to that contract on file with the commission as of
1.16the effective date of this section. Any applicable C-BED contract signed after the date of
1.17the commission's order whose provisions are not identical to the standardized contract
1.18contained in the commission's order is invalid.
1.19EFFECTIVE DATE.This section is effective the day following final enactment."

1.21 "Sec. 31.
CLEAN ENERGY RESOURCE TEAMS; APPROPRIATION.
1.22The utility subject to Minnesota Statutes, section 116C.779, shall transfer $563,000
1.23in fiscal year 2010 and $563,000 in fiscal year 2011 to the Department of Commerce
1.24on a schedule to be determined by the commissioner of commerce. The funds must be
1.25deposited in the special revenue fund and are appropriated to the commissioner for the
1.26purposes of this section.
2.1$563,000 in fiscal year 2010 and $563,000 in fiscal year 2011 are for continued
2.2funding of community energy technical assistance and outreach on renewable energy and
2.3energy efficiency, as described in Minnesota Statutes, section 216C.385. Of this amount,
2.4$113,000 each year is for technical assistance in the metropolitan area."
