1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2008, section 469.3192, is amended to read:
1.4469.3192 PROHIBITION AGAINST AMENDMENTS TO BUSINESS
1.5SUBSIDY AGREEMENT.
1.6    (a) Except as authorized under paragraph (b) or section 469.3191, under no
1.7circumstance shall terms of any agreement required as a condition for eligibility for
1.8benefits listed under section 469.315 be amended to change job creation, job retention,
1.9or wage goals included in the agreement.
1.10(b) A local unit of government and qualified business that are parties to a business
1.11subsidy agreement required as condition for eligibility for benefits listed under section
1.12469.315 may agree to amend the agreement, if the following conditions are met:
1.13(1) the only effect of the amendment is to allow a period of time, not to exceed two
1.14years, during which the qualified business is subject to lower job creation, job retention, or
1.15wage goals than were provided under the agreement prior to the amendment;
1.16(2) to the extent required by the agreement, the qualified business met or exceeded
1.17the job creation, job retention, or wage goals in the agreement for the years ending prior
1.18to the year in which the amendment is adopted, as reported on the Minnesota Business
1.19Assistance Form for the year ending December 31 or another time period prescribed
1.20by the commissioner; and
1.21(3) the commissioner approves the amendment after finding that the extension of time
1.22is justified by the inability of the qualified business to meet the original goals as a result of
1.23general business conditions or other factors that were outside the control of and were no
1.24fault of the qualified business. If the business is unable to return to the goals in the original
1.25agreement, the commissioner shall invoke section 469.319 if the business continues to
1.26operate in the zone, or section 469.3191 if the business no longer operates in the zone.
2.1EFFECTIVE DATE.This section is effective for the 2008 business subsidy
2.2reporting period, as required by Minnesota Statutes, section 116J.994, subdivision 8, and
2.3for all subsequent years."
