1.6    "Sec. 3. Minnesota Statutes 2008, section 62C.16, is amended by adding a subdivision
1.7to read:
1.8    Subd. 5. Health claims payment audits; time limit.
1.9(a) No service plan corporation providing health coverage in this state shall initiate
1.10an audit to recover a paid claim on the basis that the claim was paid for a service that was
1.11not medically necessary treatment at a time that is more than six months after the claim
1.12was paid.
1.13(b) No service plan corporation providing health coverage in this state shall withhold
1.14payment on current claims during the pendency of an audit described in paragraph (a)
1.15unless the audit dispute has reached final adjudication.
1.16(c) This section does not apply to an investigation based on a reasonable belief of
1.17suspected insurance fraud under sections 60A.951 to 60A.956 by an authorized person as
1.18defined in section 60A.951, subdivision 2.
1.19EFFECTIVE DATE.This section is effective August 1, 2009, and applies to claims
1.20paid before, on, or after that date"
