1.2Delete everything after the enacting clause and insert:
1.3 "Section 1. Minnesota Statutes 2008, section 85.46, subdivision 3, is amended to read:
1.4 Subd. 3.
Issuance. The commissioner of natural resources and agents shall issue
1.5and sell horse trail passes. The pass shall include the applicant's signature and other
1.6information deemed necessary by the commissioner. To be valid, a
daily or annual pass
1.7must be signed by the person riding, leading, or driving the horse
, and a commercial
1.8annual pass must be signed by the owner of the commercial trail riding facility.
1.9 Sec. 2. Minnesota Statutes 2008, section 85.46, subdivision 4, is amended to read:
1.10 Subd. 4.
Pass fees. (a) The fee for an annual horse trail pass is $20 for an individual
1.1116 years of age and over. The fee shall be collected at the time the pass is purchased.
1.12Annual passes are valid for one year beginning January 1 and ending December 31.
1.13(b) The fee for a daily horse trail pass is $4 for an individual 16 years of age and
1.14over. The fee shall be collected at the time the pass is purchased. The daily pass is valid
1.15only for the date designated on the pass form.
1.16(c) The fee for a commercial annual horse trail pass is $200 and includes the
1.17issuance of 15 passes. Additional passes may be purchased by the commercial trail riding
1.18facility owner at a fee of $20 each. Commercial annual horse trail passes are valid for
1.19one year beginning January 1 and ending December 31, and may be affixed to the horse
1.20tack or saddle, commercial annual passes are not transferable. For the purposes of this
1.21section, a "commercial trail riding facility" is a an operation where horses are used for
1.22riding instruction, or other equestrian activities for hire.
1.23 Sec. 3. Minnesota Statutes 2008, section 85.46, subdivision 7, is amended to read:
1.24 Subd. 7.
Duplicate horse trail passes. The commissioner of natural resources and
1.25agents shall issue a duplicate pass to a person
or commercial trail riding facility owner
2.1whose pass is lost or destroyed using the process established under section
97A.405,
2.2subdivision 3, and rules adopted thereunder. The fee for a duplicate horse trail pass is $2,
2.3with an issuing fee of 50 cents."
