1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. CITY OF EAGAN; AUTHORITY TO EXCHANGE LAND.
1.4The portion of land conveyed to the city of Eagan under Laws 1995, chapter 159,
1.5now described as Parcel No. 10-30601-090-00, Outlot I, Gopher Eagan Industrial Park 2nd
1.6Addition, may be used for a colocation facility that provides secured space for public and
1.7private Internet and telecommunications net work equipment and servers, notwithstanding
1.8the provision that the land reverts to the state if it is not used for public park or open space
1.9purposes. The commissioner of revenue is authorized to issue a state deed that provides
1.10for the land described above to be used for this purpose. The colocation facility must not
1.11be used by the municipality to provide voice, video, or Internet access services to the
1.12residents or businesses located in the city of Eagan. Nothing in this section is intended to
1.13restrict or limit the city of Eagan from communicating with its residents and businesses
1.14regarding governmental information and providing for the delivery of electronic services.
1.15EFFECTIVE DATE.This section is effective the day following final enactment."
