1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. FOOD SUPPORT FOR CHILDREN WITH SEVERE ALLERGIES.
1.4The commissioner of human services must seek a federal waiver from the federal
1.5Department of Agriculture, Food and Nutrition Service, for the supplemental nutrition
1.6assistance program, in order to provide food support for infants and children who have
1.7severe food allergies by covering nutritional food products required to treat or manage
1.8severe food allergies, including allergies to wheat and gluten.

1.9    Sec. 2. APPROPRIATION FOR FOOD SHELF PROGRAMS.
1.10$....... in the biennium beginning July 1, 2009, is appropriated from the general
1.11fund to the commissioner of human services for food shelf programs under Minnesota
1.12Statutes, section 256E.34. This appropriation is in addition to the base appropriation
1.13for the 2010-2011 biennium and becomes part of the base appropriation for fiscal years
1.142012 and 2013."
