1.3    "Sec. .... Minnesota Statutes 2008, section 270C.02, subdivision 1, is amended to read:
1.4    Subdivision 1. Commissioner; supervision of department and appointment. The
1.5Department of Revenue is under the supervision and control of the commissioner. The
1.6commissioner shall be appointed by the governor under the provisions of section 15.06.
1.7The commissioner shall be selected on the basis of ability and experience in the field of tax
1.8administration and without regard to political affiliations. The governor may not appoint
1.9as commissioner an individual who has been convicted of a criminal violation of a federal
1.10or state tax or revenue law, who has failed to file a required original individual income tax
1.11return within one year of its due date, or who has unpaid federal, state, or local taxes for a
1.12prior taxable year when the appointment is announced to the public."
