1.3Page 35, after line 11, insert:

1.4    "Sec. 28. Minnesota Statutes 2008, section 256B.69, is amended by adding a
1.5subdivision to read:
1.6    Subd. 5l. Limits on net income and administrative costs; enabling expansion of
1.7prepaid medical assistance. (a) Notwithstanding any other law to the contrary, the total
1.8monthly net income received by a managed care plan for providing covered services under
1.9the medical assistance program must not exceed six percent of the total monthly revenues
1.10the managed care plan receives from the program. For purposes of this paragraph, "net
1.11income" means total revenues received by the managed care plan under the program
1.12minus expenses and other adjustments, all as required to be defined for purposes of the
1.13managed care plan's annual Statement of Revenue, Expenses, and Net Income, prepared
1.14using the appropriate National Association of Insurance Commissioners Blank and related
1.15instructions for health maintenance organizations, as required and amended by Minnesota
1.16Rules, part 4685.1940. The managed care plan shall refund any amounts of net monthly
1.17income in excess of six percent to the commissioner, no later than 30 days after the end
1.18of each month.
1.19(b) For services rendered under paragraph (a), allowable administrative costs for a
1.20managed care plan are the per-enrollee dollar amount allowed in 2009.
1.21(c) The commissioner shall use all savings in costs to the state achieved under
1.22this subdivision to enroll in medical assistance, beginning July 1, 2010, under sections
1.23256B.055, subdivision 15 and 256B.056, subdivision 4, persons who would be eligible
1.24for general assistance medical care under the eligibility standards for general assistance
1.25medical care that were in effect as of June 30, 2009.
1.26EFFECTIVE DATE.This section is effective the day following final enactment."
