1.6(a) For the actual construction,
1.7reconstruction, and improvement of
1.8trunk highways, including design-build
1.9contracts and consultant usage to support
1.10these activities. This includes the cost
1.11of actual payments to landowners for
1.12lands acquired for highway rights-of-way,
1.13payments to lessees, interest subsidies, and
1.14relocation expenses. This appropriation is in
1.15the following amounts:
1.16(1) $417,694,000 in fiscal year 2009, and the
1.17commissioner may use up to $71,008,000 of
1.18this amount for program delivery;
1.19(2) $500,000,000 in fiscal year 2010, and the
1.20commissioner may use up to $85,000,000 of
1.21this amount for program delivery;
and
1.22(3)
$200,000,000 in each fiscal year for fiscal
1.23years 2011 and 2012, and the commissioner
1.24may use up to $34,000,000 of the amount in
1.25each fiscal year for program delivery; and
2.1(4) $100,000,000 in each fiscal year for
2.2fiscal years
2011 through 2018 2013 through
2.32016, and the commissioner may use up to
2.4$17,000,000 of the amount in each fiscal year
2.5for program delivery.
2.6(b) Of the amount in fiscal year 2009,
2.7$40,000,000 is for construction of
2.8interchanges involving a trunk highway,
2.9where the interchange will promote economic
2.10development, increase employment, relieve
2.11growing traffic congestion, and promote
2.12traffic safety. The amount under this
2.13paragraph must be allocated 50 percent to
2.14the department's metropolitan district, and 50
2.15percent to districts in greater Minnesota.
2.16(c) Of the amount in fiscal years 2009
2.17and 2010, the commissioner shall use
2.18$300,000,000 each year for predesign,
2.19design, preliminary engineering,
2.20right-of-way acquisition, construction,
2.21reconstruction, and maintenance of bridges
2.22in the trunk highway bridge improvement
2.23program under Minnesota Statutes, section
2.24165.14

2.25(d) Of the total appropriation under this
2.26subdivision, the commissioner shall use at
2.27least $50,000,000 for accelerating transit
2.28facility improvements on or adjacent to trunk
2.29highways.
2.30(e) Of the total appropriation under this
2.31subdivision provided to the Department of
2.32Transportation's district 7, the commissioner
2.33shall first expend funds as necessary to
2.34accelerate all projects that (1) are on a trunk
2.35highway classified as a medium priority
3.1interregional corridor, (2) are included in the
3.2district's long-range transportation plan, but
3.3are not included in the state transportation
3.4improvement program or the ten-year
3.5highway work plan, and (3) expand capacity
3.6from a two-lane highway to a freeway
3.7or expressway, as defined in Minnesota
3.8Statutes, section
160.02, subdivision 19. The
3.9commissioner shall establish as the highest
3.10priority under this paragraph any project that
3.11currently has a final environmental impact
3.12statement completed. The requirement
3.13under this paragraph does not change the
3.14department's funding allocation process
3.15or the amount otherwise allocated to each
3.16transportation district.
3.17(f) The appropriation in this subdivision
3.18cancels as specified under section 16A.642,
3.19except that the commissioner of management
3.20and budget shall count the start of
3.21authorization for issuance of state bonds as
3.22the first day of the fiscal year specified under
3.23paragraph (a), clause (1), (2), (3), or (4),
3.24respectively, and not as the date of enactment
3.25of this subdivision."
