1.3    "Subd. 8. Alcohol and controlled substance monitoring; alternatives. A
1.4person who qualifies to participate in the ignition interlock program under this section
1.5may petition the commissioner to be monitored by secure continuous remote alcohol
1.6monitor (SCRAM), a portable breath testing (PBT) device, or other alcohol or controlled
1.7substance monitoring methodology approved by the commissioner, in lieu of an ignition
1.8interlock. The commissioner shall determine appropriate performance standards and a
1.9certification process for any monitoring device and methodology used. Only devices and
1.10methodologies certified by the commissioner as meeting the performance standards may be
1.11used under this subdivision. The Department of Public Safety may provide the monitoring
1.12or it may contract with an appropriate public or private entity for that purpose. If the
1.13department contracts for monitoring under this section it must, as is practicable, follow the
1.14same process for contracting as it uses for the ignition interlock program under this section.
1.15The requirements and restrictions under this section pertaining specifically to ignition
1.16interlock devices shall not apply to a person who chooses to use a monitoring device or
1.17methodology other than the ignition interlock. However, to the extent practicable, the
1.18department must apply the same process it uses for the ignition interlock program."
