1.3Delete everything after the enacting clause and insert:

1.4    "Section 1. Minnesota Statutes 2008, section 326B.106, is amended by adding a
1.5subdivision to read:
1.6    Subd. 13. Lead poisoning prevention. The code must require that any renovation
1.7performed on residential property or child-occupied facilities constructed prior to 1978
1.8comply with Code of Federal Regulations, title 40, sections 745.80 to 745.92.
1.9EFFECTIVE DATE.This section is effective January 1, 2011.

1.10    Sec. 2. Minnesota Statutes 2008, section 326B.106, is amended by adding a
1.11subdivision to read:
1.12    Subd. 14. Pre-1978 structures. Any person licensed under this section and
1.13performing renovation as defined by Code of Federal Regulations, title 40, section 745.83,
1.14on a residential structure or child-occupied facility constructed prior to 1978 must be
1.15certified in accordance with Code of Federal Regulations, title 40, section 745.89, unless
1.16the property or child-occupied facility has been determined to be free of paint or other
1.17surface coating that contains lead as provided under Code of Federal Regulations, title
1.1840, section 745.82. Before the commencement of any renovation as defined by Code of
1.19Federal Regulations, title 40, section 745.83, on a residential structure or child-occupied
1.20facility constructed prior to 1978, any licensee working on the structure must provide to
1.21the commissioner proof of certification as required in this subdivision. The department
1.22shall maintain a list of certified renovators and shall make the list available to the public
1.23on its Web site.

1.24    Sec. 3. Minnesota Statutes 2008, section 326B.805, is amended by adding a
1.25subdivision to read:
2.1    Subd. 1a. Pre-1978 structures. Any person performing renovation as defined
2.2by Code of Federal Regulations, title 40, section 745.83, on a residential structure or
2.3child-occupied facility constructed prior to 1978 must comply with section 326B.106,
2.4subdivision 14."
