1.71986-1987 admissions form, and disseminate to any public educational agency or
1.8institution the following data on individuals: student sex, ethnic background, age, and
1.9disabilities. The data shall not be required of any individual and shall not be used for
1.10purposes of determining the person's admission to an institution.
1.11(b) A school district that receives information under subdivision 3, paragraph (h)
1.12from a postsecondary institution about an identifiable student shall maintain the data
1.13as educational data and use that data to conduct studies to improve instruction. Public
1.14postsecondary systems annually shall provide summary data to the Department of
1.15Education indicating the extent and content of the remedial instruction received in each
1.16system during the prior academic year by
students, categorized by the type of diploma
1.17earned under section 120B.025, and the results of assessment testing and the academic
1.18performance of
, students who graduated from a Minnesota school district within two years
1.19before receiving the remedial instruction. The department shall evaluate the data and
1.20annually report its findings to the education committees of the legislature.
1.21(c) This section supersedes any inconsistent provision of law.
1.22 Sec. 2.
[120B.025] STANDARD AND PROFICIENCY DIPLOMAS.
1.23(a) Except as provided in paragraph (b), a school district or charter school must
1.24grant a standard diploma to a student who fulfills the requirements of section 120B.02,
1.25paragraph (c).
2.1(b) If a student, in addition to fulfilling the requirements of section 120B.02,
2.2paragraph (c), also achieves a proficiency score on all assessments required under section
2.3120B.30, subdivision 1b, paragraph (c), the school district or charter school shall grant
2.4the student a proficiency diploma.
2.5(c) The school, school district, or charter school must indicate on the student's
2.6transcript whether the student received a standard diploma or a proficiency diploma."

2.25 (c) The commissioner must make available performance report cards by the
2.26beginning of each school year.
2.27 (d) A school or district may appeal its adequate yearly progress status in writing to
2.28the commissioner within 30 days of receiving the notice of its status. The commissioner's
2.29decision to uphold or deny an appeal is final.
2.30 (e) School performance report card data are nonpublic data under section
13.02,
2.31subdivision 9
, until not later than ten days after the appeal procedure described in
2.32paragraph (d) concludes. The department shall annually post school performance report
