1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2008, section 340A.90, is amended by adding a
1.4subdivision to read:
1.5    Subd. 4. Social host liability; gross misdemeanor. A person 21 years of age or
1.6older who: (1) had control over the premises and, being in a reasonable position to prevent
1.7the consumption of alcoholic beverages by a person under the age of 21 years, knowingly
1.8or recklessly permitted that consumption and the consumption caused the intoxication of
1.9that person; or (2) sold, bartered, furnished or gave to, or purchased for a person under
1.10the age of 21 years alcoholic beverages that caused the intoxication of that person, is
1.11guilty of a gross misdemeanor.
1.12EFFECTIVE DATE.This section is effective August 1, 2010, and applies to crimes
1.13committed on or after that date."
1.14Amend the title accordingly
