1.3Page 14, delete line 5 and insert:

1.4    "Sec. 22. GOVERNMENT EFFICIENCY AND TRANSPARENCY STUDIES.
1.5    Subd. 1. Data center study. (a) The commissioner of management and budget, in
1.6consultation with the state chief information officer, must study and report to the chairs
1.7and ranking minority members of the house and senate committees with jurisdiction over
1.8state government finance by January 15, 2011, on the feasibility and estimated costs of
1.9entering into a lease or lease-purchase agreement with a private nonprofit organization,
1.10involving a private sector developer, to provide a centralized data center for state agencies
1.11or to upgrade current facilities for purposes of data center consolidation. The report must
1.12include a potential schedule for consolidation of existing state agency data centers, and
1.13an estimate of any savings, increased efficiencies, or performance improvements that
1.14would be achieved through this consolidation.
1.15(b) In conducting the study required under paragraph (a), the commissioner shall
1.16consult with representatives of higher education and local government units to determine
1.17the feasibility and desirability of creating a shared service contract for a data center.
1.18(c) If the commissioner of management and budget and chief information officer
1.19conclude that entering into an agreement described in paragraph (a) is cost-beneficial, the
1.20commissioner may enter into such an agreement notwithstanding any law to the contrary."
