1.3 "Sec. .... Minnesota Statutes 2008, section 256B.69, is amended by adding a
1.4subdivision to read:
1.5 Subd. 5l. Limits on net income and administrative costs; enabling expansion
1.6of prepaid medical assistance. (a) Notwithstanding any other law to the contrary, the
1.7total net income received by a managed care plan for providing covered services under the
1.8medical assistance program must not exceed six percent of the total revenues the managed
1.9care plan receives from the program. For purposes of this paragraph, "net income" means
1.10total revenues received by the managed care plan under the program minus expenses and
1.11other adjustments, all as required to be defined for purposes of the managed care plan's
1.12annual Statement of Revenue, Expenses, and Net Income, prepared using the appropriate
1.13National Association of Insurance Commissioners Blank and related instructions for
1.14health maintenance organizations, as required and amended by Minnesota Rules, part
1.154685.1940. The managed care plan shall refund any amounts of net income in excess of
1.16six percent to the commissioner, no later than 30 days after the end of each month.
1.17(b) For services rendered under paragraph (a), allowable administrative costs for a
1.18managed care plan are the per-enrollee dollar amount allowed in 2009.
1.19(c) The commissioner shall make all savings in costs to the state achieved under
1.20this subdivision available for enrollment in medical assistance by persons who would be
1.21eligible for general assistance medical care under the eligibility standards for general
1.22assistance medical care that were in effect as of June 30, 2009.
1.23EFFECTIVE DATE.This section is effective the day following final enactment."
