1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. [299F.371] DONATION OF FIRE SUPPRESSION EQUIPMENT
1.4OR FIRE PROTECTION CLOTHING; NO CAUSE OF ACTION AGAINST
1.5CERTAIN DONORS.
1.6No cause of action arises or may be maintained against a municipality that donates
1.7equipment used to suppress fire or fire protection clothing to another municipality if
1.8the following conditions are met:
1.9(1) the equipment is approved by the state fire marshal or a designated representative;
1.10and
1.11(2) the donor agency informs the receiving agency in writing of any defects in the
1.12equipment about which it knows.
1.13For purposes of this section, "municipality" has the meaning given in section 466.01.
1.14EFFECTIVE DATE.This section is effective August 1, 2011, and applies to
1.15actions arising from incidents occurring on or after that date."

1.18relating to public safety; regulating donations of fire suppression equipment or
1.19fire protection clothing;proposing coding for new law in Minnesota Statutes,
1.20chapter 299F."
