1.3Page 53, after line 16, insert:
1.4 "Sec. 98.
CONSUMPTIVE USE OF WATER.
1.5Pursuant to Minnesota Statutes, section 103G.265, subdivision 3, the legislature
1.6approves of the consumptive use of water under a permit of more than 2,000,000 gallons
1.7per day average in a 30-day period in Cook County, in connection with snowmaking
1.8and potable water. Notwithstanding any other law to the contrary, the permit for the
1.9consumptive use of water approved under this section shall be issued, subject to the
1.10fees specified under Minnesota Statutes, section 103G.271, without any additional
1.11administrative process to withdraw up to 150,000,000 gallons of water annually for
1.12snowmaking and potable water purposes without regard to minimum flow or water level
1.13requirements. If the flow value of the river is less than the Q90 for five consecutive days,
1.14the appropriation must cease until flow levels exceed the Q90 value. The permit shall be
1.15evaluated at the end of five years for impacts to the river and possible alternative water
1.16sources."
1.17Renumber the sections in sequence and correct the internal references
1.18Amend the title accordingly
