1.2Page 1, delete section 1 and insert:

1.3    "Section 1. APPROPRIATION.
1.4The amounts necessary to repay the late contract settlement penalties imposed under
1.5section 123B.05 are appropriated from the general fund to the commissioner of education
1.6in fiscal years 2012 and 2013. These amounts are included in the general education
1.7appropriation under Minnesota Statutes, section 126C.20.
1.8EFFECTIVE DATE.This section is effective the day following final enactment.

1.9    Sec. 2. REPEALER.
1.10Minnesota Statutes 2010, section 123B.05, is repealed.
1.11EFFECTIVE DATE.This section is effective retroactive to January 1, 2010, and
1.12applies to all teacher contract settlements reached on or after that date."
