1.3 "Section 1.
[124D.031] ENROLLMENT OPTIONS FOR STUDENTS AT
1.4LOW-PERFORMING PUBLIC SCHOOLS.
1.5 Subdivision 1. Student enrollment options. (a) A student who attends a persistently
1.6low-performing school located in a city of the first class for at least one school year and
1.7whose family income is equal to or less than 175 percent of the federal poverty level is
1.8eligible to enroll in a nonpublic school under this section or in a nonresident district
1.9school or program under section 124D.03.
1.10(b) For the purposes of this section, "persistently low-performing school" means a
1.11public school located in a city of the first class that has student performance levels for at
1.12least three consecutive school years immediately preceding the school year in which a
1.13student enrolls in a nonpublic school under this section or in a nonresident district school
1.14or program under section 124D.03, as follows:
1.15(1) the combined total percentage of students scoring at the "does not meet
1.16standards" level for either the reading or mathematics Minnesota Comprehensive
1.17Assessment exceeds 40 percent for all grades tested;
1.18(2) the combined percentage of students demonstrating "proficient, low growth,"
1.19"not proficient, low growth," and "not proficient, medium growth" for either the reading or
1.20mathematics Minnesota Comprehensive Assessment exceeds 50 percent; or
1.21(3) 50 percent or more students in secondary school do not receive a passing
1.22score when first tested on the graduation required assessment for diploma in reading,
1.23mathematics, or writing.
1.24(c) For purposes of this section, a city of the first class must have met the definition
1.25of a city of the first class under section 410.01 on December 28, 2010.
2.1 Subd. 2. Eligible nonpublic schools. The nonpublic school must administer the
2.2applicable Minnesota Comprehensive Assessments in writing, reading, and mathematics
2.3under section 120B.30 to its students enrolled under this section.
2.4 Subd. 3. Tuition funding for students transferring to nonpublic schools. If a
2.5student transfers to a nonpublic school under this section, and upon receiving proof that
2.6the student is enrolled in the nonpublic school, the commissioner shall make payments
2.7to the student's parent or guardian in an amount equal to the lesser of the state average
2.8general education revenue per pupil unit, calculated without transportation sparsity
2.9revenue or the nonpublic school's operating and debt service cost per pupil that is related
2.10to educational programming, as determined by the commissioner. The commissioner
2.11shall send the check to the nonpublic school and the parent or guardian shall restrictively
2.12endorse the check for the nonpublic school's use.
2.13The scholarship payments must be made by the commissioner to the recipients in
2.14three equal payments on September 15, January 15, and July 1.
2.15 Subd. 4. Student transportation. A resident school district must provide for
2.16transportation within the district's borders for a student who enrolls in a nonpublic school
2.17under this section and shall receive transportation funding equal to the actual costs in
2.18the current school year for those transportation services according to the schedule of
2.19payments in subdivision 3.
2.20 Subd. 5. Funding for student testing. The state shall pay the nonpublic school the
2.21costs of administering applicable tests under section 120B.30.
2.22 Subd. 6. List of nonpublic schools. The commissioner shall publish a list of
2.23participating nonpublic schools.
2.24EFFECTIVE DATE.This section is effective the day following final enactment
2.25and applies to the 2012-2013 school year and later.
2.26 Sec. 2.
ENROLLMENT OPTIONS FOR STUDENTS OF LOW-PERFORMING
2.27SCHOOLS; REPORT.
2.28The commissioner of education must submit to the education policy and finance
2.29committees of the legislature by February 1, 2014, a report on the enrollment options for
2.30students at low-performing public schools under section 1. The report, at a minimum,
2.31must:
2.32(1) examine the demographics of the students participating in the program; and
2.33(2) detail the academic performance of students participating in the program,
2.34including their performance on reading and mathematics tests under Minnesota Statutes
3.12010, section 120B.30, and compare the academic performance of students of similar
3.2demographics in public schools with these students."
3.3Renumber the sections in sequence and correct the internal references
