1.2Delete everything after the enacting clause and insert:
1.3 "Section 1.
[123B.022] PROHIBITIONS ON POLITICAL ACTIVITIES BY
1.4PUBLIC SCHOOL EMPLOYEES.
1.5Local school boards shall develop and implement policies to ensure that publicly
1.6funded resources, including but not limited to time, materials, equipment, facilities, and
1.7email and other forms of technology used to communicate are not used or authorized
1.8for use by public employees to:
1.9(1) advocate the election or defeat of any candidate for elective office;
1.10(2) advocate the passage or defeat of any referendum question;
1.11(3) advocate the passage or defeat of any matter pending before a local school board,
1.12local governing body, the Minnesota Legislature, or the Congress of the United States;
1.13(4) solicit funds for political purposes; or
1.14(5) advocate for any other political issue.
1.15Such policies shall not prohibit public employees from engaging in political activities
1.16except when they are performing duties assigned to them under their employment contract
1.17with the district or representing their employer in an official capacity.
1.18Such policies shall not prohibit the use of public funds for disseminating factual
1.19information about a proposition appearing on a local ballot, if such information is factual
1.20and does not advocate for or against the proposition.
1.21All school districts must make these policies readily accessible to the public in paper
1.22copy at the district office or on the district Web site.
1.23EFFECTIVE DATE.This section is effective the day following final enactment."
