1.5    "Subdivision 1. Public school, charter school, and school district grades. (a)
1.6Consistent with the state growth targets established under sections 120B.299 and 120B.35,
1.7subdivision 3, paragraphs (a) and (b), and the school performance report cards under
1.8section 120B.36, subdivision 1, an "A to F" grading system for public schools, charter
1.9schools, and school districts is established to help identify those schools and districts
1.10where students are achieving low, medium, or high growth and achieving or not achieving
1.11proficiency on statewide assessments under section 120B.30. For purposes of this section,
1.12and using the state growth target, the commissioner annually must assign each public
1.13school, charter school, and school district enrolling students in grades 3 to 8 an "A to F"
1.14grade and then report that letter grade under section 120B.36, subdivision 1, based on
1.15the following calculations:
1.16(1) 50 percent of a school's grade must be determined based on the numbers
1.17and percentages of students who achieved proficiency on the statewide reading and
1.18mathematics assessments under section 120B.30 in the previous school year;
1.19(2) 25 percent of a school's grade must be determined based on the numbers and
1.20percentages of students who achieved low growth, medium growth, or high growth on the
1.21statewide reading and mathematics assessments under section 120B.30 in the previous
1.22school year;
1.23(3) 15 percent of a school's grade must be determined based on the numbers and
1.24percentages of students who are among the lowest 25 percent of students in the school
1.25in achievement of proficiency and who achieved low growth, medium growth, or high
1.26growth on the statewide reading assessments under section 120B.30 in the previous school
1.27year; and
2.1(4) ten percent of a school's grade must be determined based on the numbers and
2.2percentages of students who are among the lowest 25 percent of students in the school
2.3in achievement of proficiency and who achieved low growth, medium growth, or high
2.4growth on the statewide mathematics assessments under section 120B.30 in the previous
2.5school year.
2.6(b) For purposes of this section, and using the state growth target, the commissioner
2.7annually must assign each public school, charter school, and school district enrolling
2.8students in grades 9 to 12 an "A to F" grade and then report that grade under section
2.9120B.36, subdivision 1, based on the following calculations:
2.10(1) 25 percent of a school's grade must be determined based on the numbers
2.11and percentages of students who achieved proficiency on the statewide reading and
2.12mathematics assessments under section 120B.30 in the previous school year;
2.13(2) 12.5 percent of a school's grade must be determined based on the numbers and
2.14percentages of students who achieved low growth, medium growth, or high growth on the
2.15statewide reading and mathematics assessments under section 120B.30 in the previous
2.16school year;
2.17(3) 7.5 percent of a school's grade must be determined based on the numbers and
2.18percentages of students who are among the lowest 25 percent of students in the school in
2.19achievement of proficiency and who achieved low growth, medium growth, or high growth
2.20on the statewide reading assessments under section 120B.30 in the previous school year;
2.21(4) five percent of a school's grade must be determined based on the numbers and
2.22percentages of students who are among the lowest 25 percent of students in the school
2.23in achievement of proficiency and who achieved low growth, medium growth, or high
2.24growth on the statewide mathematics assessments under section 120B.30 in the previous
2.25school year;
2.26(5) 20 percent of a school's grade must be determined based on the numbers and
2.27percentages of students who successfully completed college-level advanced placement,
2.28postsecondary enrollment options including concurrent enrollment, other rigorous courses
2.29of study or industry certification courses or programs in the previous school year,
2.30consistent with section 120B.35, subdivision 3, paragraph (c), clause (2);
2.31(6) 20 percent of a school's grade must be determined based on the numbers and
2.32percentages of students prepared for postsecondary academic and career opportunities as
2.33measured by the SAT or ACT assessment or successfully completed coursework required
2.34for admission to Minnesota's public colleges and universities as determined by the Office
2.35of Higher Education under chapter 136A in the previous school year, consistent with
2.36section 120B.35, subdivision 3, paragraph (c), clause (1); and
3.1(7) ten percent of a school's grade must be determined based on the four-year high
3.2school graduation rate for students in the graduating class in the previous school year.
3.3(c) Using the calculations in paragraph (a), clauses (1) to (4), and paragraph (b),
3.4clauses (1) to (7), a school district's grade must be determined based on the combined
3.5average scores of all district schools.
3.6(d) The grade a school or district receives under this subdivision must accurately
3.7reflect the differences in schools' performances and the calculations required under this
3.8subdivision. A school or district may appeal its grade in writing to the commissioner
3.9within 30 days of receiving notice of its grade. The commissioner's decision regarding
3.10the grade is final. Grades given under this section are nonpublic data under section
3.1113.02, subdivision 9, until not later than ten days after the appeal under this paragraph
3.12is complete."

3.14    "Subd. 3. "D" and "F" letter grades. A school or district assigned a letter grade of
3.15"D" or "F" in each of the two previous school years must develop and implement a process
3.16for reviewing curriculum, instruction, and student achievement consistent with section
3.17120B.11. A school or district under this subdivision must comply with the requirements of
3.18this subdivision for at least three consecutive school years and until the commissioner
3.19assigns a letter grade of "C" or higher to the school or district for two consecutive school
3.20years. The commissioner annually must review the school or district instruction and
3.21curriculum improvement plan required under this subdivision and determine its effect on
3.22student progress in meeting state and local academic standards."
