3.5    "Sec. 3. [15B.34] STATE CAPITOL PRESERVATION COMMISSION.
3.6    Subdivision 1. Definitions. The definitions in this subdivision apply to this section
3.7and section 15B.35.
3.8    (a) "Commission" means the State Capitol Preservation Commission established
3.9in this section.
3.10    (b) "Capitol area" means the geographic area defined by section 15B.02.
3.11    (c) "Board" means the Capitol Area Architectural and Planning Board.
3.12    (d) "Predesign" means the stage in the development of a project during which the
3.13purpose, scope, cost, and schedule of the complete project are defined and instructions to
3.14design professionals are produced.
3.15    Subd. 2. Establishment; membership. There is established a State Capitol
3.16Preservation Commission. The commission consists of:
3.17    (1) the governor or the governor's designee;
3.18    (2) the lieutenant governor;
3.19    (3) the president of the senate or the president's designee who shall be a member
3.20of the senate;
3.21    (4) the speaker of the house or the speaker's designee who shall be a member
3.22of the house;
3.23    (5) the attorney general;
3.24    (6) two members of the senate appointed by the president of the senate, one from the
3.25majority and one from the minority parties;
3.26    (7) two members of the house of representatives appointed by the speaker of the
3.27house, one from the majority and one from the minority parties;
3.28(8) the chief justice of the Minnesota Supreme Court, or the chief justice's designee
3.29who shall be a member of the supreme court;
3.30    (9) the commissioner of the Department of Administration, or the commissioner's
3.31designee;
3.32    (10) the commissioner of the Department of Public Safety, or the commissioner's
3.33designee;
3.34    (11) the executive director of the Minnesota Historical Society, or the executive
3.35director's designee;
3.36    (12) the executive secretary of the board; and
4.1    (13) two citizen members, at least one of whom is experienced in the areas of
4.2architecture, design, or construction, appointed by the governor with the advice and
4.3consent of both the president of the senate and the speaker of the house.
4.4    Subd. 3. Organization. (a) The governor, lieutenant governor, president of the
4.5senate, and speaker of the house shall serve terms coterminous with their term as governor,
4.6lieutenant governor, president, or speaker. Citizen members shall serve two-year terms
4.7and may not serve for more than two consecutive terms. The provisions in section 15.0575
4.8govern the removal of members and the filling of any vacancies on the commission.
4.9    (b) The governor is the chair of the commission. The lieutenant governor is the vice
4.10chair. When the governor is unable to attend a meeting, the lieutenant governor shall act
4.11as the chair. The commission shall meet at least quarterly and at other times at the call
4.12of the governor or if four members of the commission request a meeting in writing and
4.13provide notice to all other members of the commission at least ten days in advance of
4.14the proposed meeting. Notice of all meetings must be provided in accordance with the
4.15requirements for public meetings.
4.16    (c) The commissioner of administration may designate an employee of the
4.17Department of Administration to serve as executive secretary of the commission and may
4.18furnish administrative staff to the commission as necessary for the expeditious conduct of
4.19the commission's duties and responsibilities.
4.20    (d) Commission members who are not state employees shall receive no
4.21compensation, benefits, per diem, or reimbursement for expenses for their services. State
4.22government officers and employees shall receive no additional compensation, per diem, or
4.23reimbursement of expenses beyond what is provided by their organizations or as otherwise
4.24provided by law. Legislative members may receive the payment authorized by legislative
4.25rule and provided by the senate or house, respectively.
4.26    Subd. 4. Powers and duties; commission. The commission has the following
4.27powers and duties.
4.28    (a) Exercise complete stewardship over the restoration and preservation of the
4.29capitol building.
4.30    (b) Consult with and advise the Department of Administration, the board, and the
4.31Minnesota Historical Society regarding their statutory responsibilities for and in the
4.32capitol building.
4.33    (c) In accordance with procurement laws, rules, and procedures, select an
4.34architectural firm to assist the commission, upon the commission's request, in the
4.35performance of its duties herein. Payment for the services of the architectural firm shall be
4.36made as required from funds designated for that purpose.
5.1    (d) Develop a comprehensive, multiyear, predesign plan for the restoration of the
5.2capitol building and review such plan periodically and, as appropriate, to amend and
5.3modify the plan. The predesign plan shall identify appropriate and required functions of
5.4the capitol building; identify and address space requirements for legislative, executive,
5.5and judicial branch functions; and identify and address the long-term maintenance and
5.6preservation requirements of the capitol building. In developing the plan, the commission
5.7shall take into account the Comprehensive Plan for the Minnesota State Capitol Area,
5.8as amended in 2010, the Rules Governing Zoning and Design for the Capitol Area,
5.9parking, mass transit, citizen access, the tunnel system, information technology needs,
5.10energy efficiency, security, and any additional space needs for the efficient operation of
5.11state government.
5.12    (e) Develop and implement a comprehensive financial plan to fund the preservation
5.13and restoration of the capitol building. The commission shall submit this plan to the 2012
5.14legislature and future legislatures until restoration of the capitol building is completed, as
5.15determined by the commission.
5.16    (f) Provide public reports on its work, including informing the public on an ongoing
5.17basis of the condition of the capitol building and its needs as well as all activities related
5.18to the restoration of the capitol building.
5.19    (g) Solicit gifts, grants, or donations of any kind from any private or public source
5.20to carry out the purposes of this section. All gifts, grants, or donations received directly
5.21by the commission shall be transmitted to the state treasurer who shall credit the fund
5.22established in section 15B.35.
5.23    (h) Approve all modifications of any kind to the capitol building interior and
5.24exterior, whether in public or nonpublic spaces.
5.25    Subd. 5. Powers and duties; Department of Administration. The commissioner
5.26of administration, upon the receipt of funding for such purposes, shall:
5.27    (1) maintain and operate the capitol building and grounds in accordance with section
5.2816B.24 and other applicable law;
5.29    (2) designate a project manager to oversee and manage predesign, design, and
5.30construction contracts and funding for all modifications of the capitol building;
5.31    (3) manage design and construction projects and funding for the capitol building in
5.32accordance with section 16B.31 and other applicable law;
5.33    (4) lease space to state agencies, constitutional officers, and the court administrator
5.34on behalf of the judicial branch in accordance with section 16B.24, and allocate space to
5.35the legislative branch as determined by the commission;
6.1    (5) provide information to the commission, legislative bodies and others as
6.2needed regarding maintenance, operation, leasing, condition assessments, design, and
6.3construction projects; and
6.4    (6) assist the commission with performance of its duties as needed.
6.5    Subd. 6. Powers and duties; Capitol Area Architectural and Planning Board.
6.6    The board shall:
6.7    (1) jointly with the commissioner of administration establish standards and polices
6.8for the repair, furnishing, appearance, cleanliness of, and change to, the public and
6.9ceremonial areas of the capitol building;
6.10    (2) review and approve plans and specifications and any changes to approved plans
6.11and specifications involving the alteration of the public and ceremonial areas and the
6.12exterior of the capitol building;
6.13    (3) jointly with the executive director of the Minnesota Historical Society review
6.14and approve the design, structural composition, and location of all monuments, memorials,
6.15or works of art presently located in the public and ceremonial areas of the state capitol
6.16or which shall be placed in such public or ceremonial areas in accordance with section
6.17138.68; and
6.18    (4) assist the commission with the performance of its duties as needed.
6.19    Subd. 7. Powers and duties; Minnesota Historical Society. The executive director
6.20of the Minnesota Historical Society shall:
6.21    (1) assist and advise in research and preservation of historical features of the capitol
6.22building, appropriate custodial policies, and maintaining works of art in accordance with
6.23section 138.69;
6.24    (2) jointly with the board review and approve the design, structural composition, and
6.25location of all monuments, memorials, or works of art presently located in the public and
6.26ceremonial areas of the state capitol or which shall be placed in such public or ceremonial
6.27areas in accordance with section 138.68; and
6.28    (3) assist the commission with performance of its duties as needed.

6.29    Sec. 4. [15B.35] STATE CAPITOL PRESERVATION FUND.
6.30    A state capitol preservation fund is established in the state treasury. All money in
6.31the fund is appropriated to the commissioner of administration to support the activities
6.32of the State Capitol Preservation Commission under section 15B.34, including but not
6.33limited to the commission's development and implementation of a capitol preservation
6.34predesign plan."
