1.3Page 3, delete section 3, and insert:

1.4    "Sec. 3. Minnesota Statutes 2010, section 18B.03, subdivision 1, as amended by Laws
1.52011, chapter 14, section 7, is amended to read:
1.6    Subdivision 1. Administration by commissioner. The commissioner shall
1.7administer, implement, and enforce this chapter and the Department of Agriculture
1.8is the lead state agency for the regulation of pesticides. The commissioner has the
1.9sole regulatory authority over the terrestrial application of pesticides, including, but
1.10not limited to, the application of pesticides to agricultural crops, structures, and other
1.11nonaquatic environments. Except as provided in subdivision 3, a state agency other than
1.12the Department of Agriculture shall not regulate or require permits for the terrestrial
1.13or nonaquatic application of pesticides."
1.14Amend the title accordingly
