1.3    "Sec. 3. [177.421] PREVAILING WAGE DETERMINATIONS.
1.4    Subdivision 1. Highway and heavy construction. The department shall, at least
1.5once every two calendar years, determine and certify prevailing wage rates applicable
1.6to state projects which are similar in nature to public and private highway and heavy
1.7construction projects where the estimated total cost of completing the project is $25,000
1.8or more.
1.9    Subd. 2. Commercial type construction. The department shall, at least once every
1.10two calendar years, determine and certify prevailing wage rates applicable to state projects
1.11which are similar in nature to public and private commercial projects where the estimated
1.12total cost of completing the project is $2,500 or more.
1.13    Subd. 3. Survey data. Each wage survey shall be based upon work performed
1.14in the 24 months preceding the date the survey is commenced and the resulting wage
1.15determinations will be certified following the close of the survey.
1.16    Subd. 4. Rule modification. The commissioner shall adopt or amend rules as
1.17necessary to reflect this section. Rules may be adopted or amended using the process
1.18under section 14.388.

1.19    Sec. 4. REPEALER.
1.20Minnesota Rules, part 5200.1020, subparts 1, 2, and 5, are repealed."
