1.2Delete everything after the enacting clause and insert:
1.3 "Section 1. Minnesota Statutes 2010, section 239.77, subdivision 3, is amended to read:
1.4 Subd. 3.
Exceptions. (a) The minimum content requirements of subdivision 2 do
1.5not apply to fuel used in the following equipment:
1.6 (1) motors located at an electric generating plant regulated by the Nuclear
1.7Regulatory Commission;
1.8 (2) railroad locomotives;
1.9 (3) off-road taconite and copper mining equipment and machinery;
and
1.10 (4) off-road logging equipment and machinery
; and.
1.11 (5) until May 1, 2010, vehicles and equipment used exclusively on an aircraft
1.12landing field.
1.13 (b) The exemption in paragraph (a), clause (1), expires 30 days after the Nuclear
1.14Regulatory Commission has approved the use of biodiesel fuel in motors at electric
1.15generating plants under its regulation.
1.16 (c) This subdivision expires on May 1,
2012 2020.
1.17 Sec. 2. Laws 2010, chapter 228, section 4, is amended to read:
1.18 Sec. 4.
EXTENSION OF COMMISSIONER'S ORDER.
1.19The order by the commissioner of commerce exempting number 1 diesel fuel from
1.20the biodiesel content requirements under Minnesota Statutes, section
239.77, subdivision
1.212
, paragraph (a), is extended until March 31,
2012 2015, for the months of October,
1.22November, December, January, February, and March.
1.23 Sec. 3.
EFFECTIVE DATE.
1.24Sections 1 and 2 are effective April 1, 2012."
