COMMISSIONER TO SEEK AMENDMENT FOR EXCEPTION
1.5TO CONSUMER-DIRECTED COMMUNITY SUPPORTS BUDGET
1.6METHODOLOGY.
1.7By July 1, 2012, the commissioner of human services shall request an amendment
1.8to the home and community-based services waiver for persons with developmental
1.9disabilities to establish an exception to the consumer-directed community supports budget
1.10methodology to provide up to 20 percent more funds for those participants who have
1.11their 21st birthday and graduate from high school during 2013 and 2014 and are enrolled
1.12in consumer-directed community supports prior to graduation. The exception may be
1.13provided to those who can demonstrate that they will have to leave consumer-directed
1.14community supports and use traditional agency services because their needs for services
1.15during the day cannot be met within the consumer-directed community supports budget
1.16limits. Specific criteria and data to be evaluated for this exception will be developed in
1.17consultation with the consumer-directed community supports stakeholders group prior to
1.18submission of the waiver amendment. The experience with this exception shall be used
1.19to make changes to the consumer-directed community supports budget methodology to
1.20better accommodate the needs of those who transition from school to adult services. The
1.21exception process shall be effective upon federal approval for persons eligible during 2013
1.22and 2014. Participants will have access to the higher allocation for up to three years and
1.23their plan will be reviewed yearly to determine if additional dollars are needed.
1.24EFFECTIVE DATE.This section is effective the day following final enactment."
