1.3    "Sec. 2. [115.84] WASTEWATER LABORATORY CERTIFICATION.
1.4    Subdivision 1. Wastewater laboratory certification required. (a) Laboratories
1.5performing wastewater or water analytical laboratory work, the results of which are
1.6reported to the agency to determine compliance with a national pollutant discharge
1.7elimination system (NPDES) permit condition or other regulatory document, must be
1.8certified according to this section.
1.9(b) This section does not apply to:
1.10(1) laboratories that are private and for-profit;
1.11(2) laboratories that perform drinking water analyses; or
1.12(3) laboratories that perform remediation program analyses, such as Superfund or
1.13petroleum analytical work.
1.14(c) Until adoption of rules under subdivision 2, laboratories required to be certified
1.15under this section and submitting data to the agency must register by submitting
1.16registration information required by the agency or be certified or approved by a recognized
1.17certification authority, as required by agency programs.
1.18    Subd 2. Rules. The agency may adopt rules to govern certification of laboratories
1.19according to this section. Notwithstanding section 16A.1283, the agency may adopt
1.20rules establishing fees.
1.21    Subd. 3. Fees. (a) Until the agency adopts a rule establishing fees for certification,
1.22the agency shall collect fees in amounts necessary to cover the reasonable costs of
1.23the certification program, including reviewing applications, issuing certifications, and
1.24conducting audits and compliance assistance.
1.25(b) Fees under this section must be based on the number, type, and complexity of
1.26analytical methods that laboratories are certified to perform.
2.1(c) Revenue from fees charged by the agency for certification shall be credited to
2.2the environmental fund.
2.3    Subd. 4. Enforcement. (a) The commissioner may deny, suspend, or revoke
2.4wastewater laboratory certification for, but is not limited to, any of the following reasons:
2.5fraud, failure to follow applicable requirements, failure to respond to documented
2.6deficiencies or complete corrective actions necessary to address deficiencies, failure to pay
2.7certification fees, or other violations of federal or state law.
2.8(b) This section and the rules adopted under it may be enforced by any means
2.9provided in section 115.071."
2.10Page 7, delete lines 26 and 27 and insert:
2.11"(1) request the commissioner of administration to dispose of the property according
2.12to sections 16B.281 to 16B.287, subject to conditions the commissioner"
2.13Renumber the sections in sequence and correct the internal references
