1.3    "Sec. 2. Minnesota Statutes 2012, section 84.9275, subdivision 1, is amended to read:
1.4    Subdivision 1. Pass required; fee. (a) A tribal member exempt from registration
1.5under section 84.922, subdivision 1a, clause (2), or a nonresident may not operate an
1.6all-terrain vehicle on a state or grant-in-aid all-terrain vehicle trail unless the operator
1.7carries a valid nonresident all-terrain vehicle state trail pass in immediate possession. The
1.8pass must be available for inspection by a peace officer, a conservation officer, or an
1.9employee designated under section 84.0835.
1.10(b) The commissioner of natural resources shall issue a pass upon application and
1.11payment of a $20 fee. The pass is valid from January 1 through December 31. Fees
1.12collected under this section, except for the issuing fee for licensing agents, shall be
1.13deposited in the state treasury and credited to the all-terrain vehicle account in the natural
1.14resources fund and, except for the electronic licensing system commission established by
1.15the commissioner under section 84.027, subdivision 15, must be used for grants-in-aid to
1.16counties and municipalities for all-terrain vehicle organizations to construct and maintain
1.17all-terrain vehicle trails and use areas.
1.18    (c) A nonresident all-terrain vehicle state trail pass is not required for:
1.19    (1) an all-terrain vehicle that is owned and used by the United States, another state,
1.20or a political subdivision thereof that is exempt from registration under section 84.922,
1.21subdivision 1a;
1.22    (2) a person operating an all-terrain vehicle only on the portion of a trail that is
1.23owned by the person or the person's spouse, child, or parent; or
1.24(3) a nonresident operating an all-terrain vehicle that is registered according to
1.25section 84.922."
1.26Renumber the sections in sequence and correct the internal references
1.27Amend the title as follows:
2.1Page 1, line 3, after the semicolon, insert "modifying nonresident all-terrain vehicle
2.2state trail pass requirements;"
2.3Correct the title numbers accordingly
