1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. FUND TRANSFER; ELK RIVER.
1.4(a) Notwithstanding Minnesota Statutes, section 123B.79, 123B.80, or 475.61,
1.5subdivision 4, on June 30, 2014, Independent School District No. 728, Elk River, may
1.6make a permanent transfer of $3,000,000 from its debt redemption fund to its undesignated
1.7general balance fund without making a levy reduction.
1.8(b) For fiscal years 2016, 2017, and 2018, the commissioner of education shall
1.9exclude the amount transferred under paragraph (a) from the debt service equalization aid
1.10calculation under Minnesota Statutes, section 123B.53, for Independent School District
1.11No. 728, Elk River.
1.12EFFECTIVE DATE.This section is effective June 30, 2014."
