1.5(a) The following officers have the powers of a notary public within the state:
1.6(1) every member of the legislature, while still a resident in the district from which
1.7elected; but no fee or compensation may be received for exercising these powers
. The
1.8form of the official signature in these cases is: "A.B., Representative (or Senator),
1.9....................................... District, Minnesota, ex officio notary public. My term expires
1.10January 1, .......";
1.11(2) the clerks or recorders of towns, and cities
. The form of the official signature in
1.12these cases is: "A.B. (official title), ....... County, Minnesota, ex officio notary public. My
1.13term expires ....... (or where applicable) my term is indeterminate.";
1.14(3) court commissioners, county recorders, and county auditors, and their several
1.15deputies, and county commissioners, all within their respective counties
. The form of the
1.16official signature in these cases: "A.B. (official title), ....... County, Minnesota, ex officio
1.17notary public. My term expires ....... (or where applicable) my term is indeterminate."; and
1.18(4) peace officers licensed under section
626.845 for the purpose of administering
1.19oaths upon information submitted to establish probable cause to any judge or judicial
1.20officer under the Rules of Criminal Procedure. The form of the official signature in these
1.21cases is "A.B., Peace Officer License Number ......., ....... County, Minnesota. My license
1.22expires June 30, .......".
1.23(b) An officer using the powers of a notary public within the state pursuant to clauses
1.24(1) to (3) shall obtain an official stamp as specified under section
359.03, subdivisions 1,
1.253, and 4, with which to authenticate official acts.
2.1(c) The county auditor and county recorder, and their deputies, and the clerk or
2.2recorder of a town or city with ex officio powers under this section may authenticate
2.3official acts related to the statutory duties of their respective offices without using the
2.4official stamp for 90 days after initially assuming the office, or until the officer acquires an
2.5official stamp, whichever is earlier.
2.6 Sec. 3. Minnesota Statutes 2012, section 359.03, subdivision 3, is amended to read:
2.7 Subd. 3.
Specifications. (a) The official notarial stamp
for a notary commissioned
2.8under section 359.01 consists of the seal of the state of Minnesota, the name of the notary
2.9as it appears on the commission
or the name of the ex officio notary, the words "Notary
2.10Public,"
or "Notarial Officer" in the case of an ex officio notary, and the words "My
2.11commission expires ...............
(or where applicable) My term is indeterminate," with the
2.12expiration date shown on it and" (with the date of expiration in place of the blank). The
2.13stamp must be able to be reproduced in any legibly reproducible manner.
2.14(b) The official notarial stamp for an ex officio notary consists of:
2.15(1) the seal of the state of Minnesota;
2.16(2) the name of the ex officio notary, and the name of the office and the governmental
2.17jurisdiction that makes the person an ex officio notary;
2.18(3) the words "Notarial Officer;" and
2.19(4) the words:
2.20(i) "My term expires ......." (with the date of the expiration in place of the blank); or
2.21(ii) (where applicable) "My term is indeterminate"; or
2.22(iii) the words "My term expires ......." (with the date of expiration to be handwritten
2.23by the notarial official in place of the blank each time the stamp is used).
2.24The stamp must be able to be reproduced in any legibly reproducible manner.
2.25(c) The official notarial stamp shall be a rectangular form of not more than
2.26three-fourths of an inch vertically by 2-1/2 inches horizontally, with a serrated or milled
2.27edge border, and shall contain the information required by this subdivision."
