1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. ELECTRIC FISH BARRIER.
1.4The commissioner of natural resources shall enter into a contract to design an
1.5electric fish barrier using the most modern technology available for fish dispersal systems.
1.6The electric fish barrier must include a sweeping or active field barrier with sonar capable
1.7of being reconfigured into a graduated field fish barrier. The electric fish barrier shall be
1.8located at United States Army Corps of Engineers, St. Paul District, Lock and Dam 1. The
1.9commissioner shall award the contract no later than March 15, 2013.
1.10EFFECTIVE DATE.This section is effective the day following final enactment.

1.11    Sec. 2. APPROPRIATION.
1.12The unexpended amount appropriated from the outdoor heritage fund to design,
1.13construct, operate, and evaluate structural deterrents for Asian carp in Laws 2012, chapter
1.14264, article 1, section 2, subdivision 5, paragraph (h), must be spent to design the electric
1.15fish barrier at Lock and Dam 1 required under section 1.
1.16EFFECTIVE DATE.This section is effective the day following final enactment."
