1.4 "Sec. 11.
MENTALLY ILL OFFENDERS ARRESTED OR SUBJECT TO
1.5ARREST; WORKING GROUP.
1.6 Subdivision 1. Working group established; study and draft legislation required.
1.7The commissioner of human services may convene a working group to address issues
1.8related to offenders with mental illness who are arrested or subject to arrest. The working
1.9group shall consider the special needs of these offenders and determine how best to
1.10provide for these needs. Specifically, the group shall consider the efficacy of a facility
1.11that would serve as a central point for accepting, assessing, and addressing the needs of
1.12offenders with mental illness brought in by law enforcement as an alternative to arrest or
1.13following arrest. The facility would consolidate and coordinate existing resources as well
1.14as offer new resources that would provide a continuum of care addressing the immediate,
1.15short-term, and long-term needs of these offenders. The facility would do the following for
1.16these offenders: perform timely, credible, and useful mental health assessments; identify
1.17community placement opportunities; coordinate community care; make recommendations
1.18concerning pretrial release when appropriate; and, in some cases, provide direct services
1.19to offenders at the facility or in nearby jails. The working group shall establish criteria
1.20to determine which offenders may be admitted to the facility. The facility would be
1.21located in the metropolitan region and serve the needs of nearby counties. The facility
1.22would represent a partnership between the state, local units of government, and the private
1.23sector. In addition, the working group may consider how similar facilities could function
1.24in outstate areas. When studying this issue, the working group shall examine what other
1.25states have done in this area to determine what programs have been successful and use
1.26those programs as models in developing the program in Minnesota. The working group
1.27may also study and make recommendations on other ways to improve the process for
2.1addressing and assisting these offenders. The commissioner shall enter into an agreement
2.2with NAMI Minnesota to carry out the work of the working group.
2.3 Subd. 2. Membership. The commissioner shall ensure that the working group
2.4has expertise and a broad range of interests represented, including, but not limited to:
2.5prosecutors; law enforcement, including jail staff; correctional officials; probation
2.6officials; criminal defense attorneys; judges; county and city officials; mental health
2.7advocates; mental health professionals; and hospital and health care officials.
2.8 Subd. 3. Administrative issues. (a) The commissioner shall convene the first
2.9meeting of the working group by September 1, 2014. NAMI Minnesota shall provide
2.10meeting space and administrative support to the working group. The working group shall
2.11select a chair from among its members.
2.12(b) The commissioner may solicit in-kind support from work group member
2.13agencies to accomplish its assigned duties.
2.14 Subd. 4. Report required. By January 1, 2015, the working group shall submit a
2.15report to the chairs and ranking minority members of the senate and house of representatives
2.16committees and divisions having jurisdiction over human services and public safety. The
2.17report must summarize the working group's activities and include its recommendations
2.18and draft legislation. The recommendations must be specific and include estimates of the
2.19costs involved in implementing the recommendations, including the funding sources that
2.20might be used to pay for it. The working group shall explore potential funding sources
2.21at the federal, local, and private levels, and provide this information in the report. In
2.22addition, the report must include draft legislation to implement the recommendations."
