1.3    "Sec. 3. Minnesota Statutes 2012, section 216B.241, is amended by adding a
1.4subdivision to read:
1.5    Subd. 5e. On-bill loan repayment program; pilot project. The commissioner shall
1.6solicit proposals for one or more utilities to voluntarily participate in a pilot program that
1.7allows one or more commercial buildings, including multi-family residential buildings,
1.8to participate in an on-bill loan repayment program. Each pilot program must utilize the
1.9criteria and standards of, and must comply with the requirements of, subdivision 5d. A
1.10pilot program operated under this subdivision may be included in a utility's conservation
1.11improvement plan under this section, or proposed separately. In determining whether to
1.12approve a pilot program under this subdivision, the commissioner shall consider the extent
1.13of support for the pilot program from the building's owner, the utility serving the building,
1.14and organizations promoting energy efficiency. The commissioner may approve a pilot
1.15program under this subdivision that allows tenants occupying units in the commercial
1.16building to participate in repaying a loan undertaken under the program, provided that
1.17tenants are not required to pay the costs of any improvements that do not benefit them.
1.18EFFECTIVE DATE.This section is effective the day following final enactment."
