1.3Page 60, delete section 31, and insert:

1.4    "Sec. .... Minnesota Statutes 2012, section 150A.091, subdivision 16, is amended to
1.5read:
1.6    Subd. 16. Failure of professional development portfolio audit. A licensee shall
1.7submit a fee as established by the board not to exceed the amount of $250 after failing two
1.8consecutive professional development portfolio audits and, thereafter, for each failed (a) If
1.9a licensee fails a professional development portfolio audit under Minnesota Rules, part
1.103100.5300, the board is authorized to take the following actions:
1.11(1) For the first failure, the board may issue a warning to the licensee;
1.12(2) For the second failure within ten years, the board may assess a penalty of not
1.13more than $250; and
1.14(3) For any additional failures within the ten year period, the board may assess a
1.15penalty of not more than $1000.
1.16(b) In addition to the penalty fee, the board may initiate the complaint process to
1.17address multiple failed audits."
1.18Renumber the sections in sequence and correct the internal references
1.19Amend the title accordingly
