1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2012, section 306.02, subdivision 2, is amended to read:
1.4    Subd. 2. Transfer by local government unit. Cemetery land and property or a
1.5public burial ground owned or controlled by a town, statutory or home rule charter city, or
1.6county may be transferred by deed or otherwise to an existing cemetery association or
1.7corporation or one, a cemetery association or corporation formed under this chapter, or
1.8a cemetery association or corporation formed under the laws of a federally recognized
1.9Indian tribe in Minnesota. The transfer may be with or without condition, as determined
1.10by the town, statutory or home rule charter city, or county. The town, statutory or home
1.11rule charter city, or county may, as a part of the transaction, enter into a contract or
1.12agreement with the cemetery association to provide for the management and maintenance
1.13of the cemetery, for the sale of lots or land in the cemetery, and for those other matters
1.14concerning the care and control of the cemetery as the town, statutory or home rule charter
1.15city, or county considers advisable.
1.16EFFECTIVE DATE.This section is effective the day following final enactment."
