MINUTES

Representative Kahn, Chair of the Legacy Committee, called the meeting to order at 2:19 P.M. on April 10, 2013 in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Chair Kahn moved that HF1183 be recommended to pass and be re-referred to the Committee on Ways and Means.

Chair Kahn moved the H1183DE5 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Janelle Taylor, House Research, explained Articles 1, 2 and 3 of the H1183DE5 amendment.

Mary Mullen, House Research, explained Article 4 of the H1183DE5 amendment.

Representative John Persell gave an overview of the Clean Water Act portion of H1183DE5.

Mike Schmidt, Water Quality Program Associate, MN Center for Environmental Advocacy, responded to member questions.

Representative Torkelson moved an oral amendment to HF1183DE5 as follows:

Page 56, line 8, after “watershed” insert, “no larger than a hydrologic unit code 8”

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved the H1183A44 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Torkelson moved the H1183A30 amendment.

Sarah Strommon, Assistant Director, Board of Water and Soil Resources, responded to member questions.

Representative Torkelson requested a roll call vote. The results were as follows:

On a vote of 6 AYES and 6 NAYS THE MOTION DID NOT PREVAIL.

Chair Kahn moved the H1183A28 amendment.

Bruce Chamberlin, Assistant Supervisor of Planning, Minneapolis Park Board, responded to member questions.

Representative Loeffler testified in support of the amendment.

Bob Meier, Director of Policy and Government Relations, Department of Natural Resources, testified against the amendment.

Representative Torkelson requested a roll call vote. The results were as follows:

On a vote of 6 AYES and 5 NAYS THE MOTION PREVAILED.

At 3:56 P.M., Chair Kahn moved a recess until the call of the chair.

Chair Kahn reconvened the committee at 7:29 P.M.

Vice-Chair Lillie moved to reconsider the H1183A28 amendment. THE MOTION PREVAILED.

Chair Kahn moved the H1183A28 amendment. THE MOTION DID NOT PREVAIL.

Chair Kahn moved the H1183A50 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.


Chair Kahn moved an oral amendment to HF1183DE5 as follows:

Page 2, line 16, delete “75,000” and insert, “150,000”

Page 78, line 15, delete the second “1,240,750” and insert, “1,290,750”

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Lead Republican Urdahl moved the H1183A45 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Torkelson moved the H1183A35 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved the H1183A32 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Green moved the H1183A42 amendment. THE MOTION DID NOT PREVAIL.

Lead Republican Urdahl moved the H1183A48 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Torkelson moved the H1183A49 amendment, incorporating the following oral amendment:

Page 1, line 3, delete, “2,625,000” and insert, “2,525,000”

Page 1, line 4, delete “200,000” and insert, “100,000”

THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Green moved the H1183A36 amendment, incorporating the following oral amendment:

Page 4, line 10, delete, “trains” and insert, “trails”

Jim Nobles, Legislative Auditor, Office of the Legislative Auditor, responded to member questions.

Representative Green renewed his motion that the H1183A36 amendment, as amended, be adopted. THE MOTION PREVAILED AND THE AMENDMENT AS AMENDED WAS ADOPTED.

Chair Kahn renewed her motion that HF1183 be passed, as amended, and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

The meeting was adjourned at 8: 29 P.M.
