Legislative Update from Rep. Brian Daniels

Dear Neighbors,

On Wednesday, the House Public Safety Committee held a hearing on two bills that would have serious ramifications on the Second Amendment rights of law-abiding Minnesotans.

House File 8 would dramatically expand requirements and limits on the transfer, or sale, of firearms.

While supporters of this legislation claim that it is about background checks for all gun purchases, this bill instead creates new burdens and hurdles for law-abiding Minnesotans seeking to exercise their Second Amendment rights. Further, the bill would inadvertently turn people into criminals if they don't follow the exact processes laid out in this bill.

The second bill, House File 9, establishes an “extreme risk protection order” process giving someone the ability to petition a court of law to have your firearms seized by law enforcement if they believe you are a risk to yourself or to others.

This bill effectively treats people as guilty until proven innocent, which goes against the principles of our legal system, violates due process and will not stop those who are intent on doing harm to others.

I am concerned that neither of these bills address the root cause of gun violence. As I strong supporter of the Second Amendment, I will continue to stand for law-abiding Minnesotans’ right to keep and bear arms.
