SAINT PAUL, Minn. - Today, the Minnesota House passed House File 1019, authored by Rep. Sandra Feist (DFL – New Brighton). In the event of a plaintiff’s death, this bill will allow a family to recover all the damages a person suffered before death in a wrongful death or injury action, as in all other states. This bill will eliminate any benefit for delaying the resolution of a claim. The bill passed on a bipartisan vote of 77-48.
“Minnesota is known for fairness in our judicial system,” said Rep. Feist. “However, with this glaring injustice, Minnesota is the outlier across the nation. This bill will eliminate the perverse incentive to stall claims and wait for someone’s death to evade accountability for wrongful acts. I’m grateful for the bipartisan support for those who have legitimate injury claims. Today we took an important step forward to ensuring justice for Minnesotans.”
The Senate’s companion bill is moving through its committee processes. Video of the bill presentation can be viewed on the House Public Information’s YouTube Channel.
