House Passes Minnesota Partition Act

SAINT PAUL, MINN. -- Today, the Minnesota House passed HF359/SF202, the Minnesota Partition Act. The bill modernizes Minnesota’s statute on property partition, which has not been updated in 120 years. The bill also updates statute to reflect case law on partitions, clarifies law on eminent domain, and makes last term’s Transfer on Death Deed (TODD) law retroactive. The bill passed on a vote of 119-12. 

The bill is authored by Rep. Sandra Feist (DFL – New Brighton). Rep. Feist released the following statement:  

“Now that the tied House has been restored, I'm so excited that this bill is among the first to pass off the House Floor. We passed my initial TODD bill almost exactly one year ago, and these important technical changes will ensure that navigating paperwork doesn’t affect people’s property rights in court. This bill also makes some important updates to state statutes to provide clarity and reflect modern practices.”  

The bill now heads to Governor Walz for signature.
