Chair Huntley called to order the twenty-ninth meeting of the Health Care and Human Services Finance Committee at 10:13 a.m. in Room 200 of the State Office Building on Thursday, March 21, 2013. The committee legislative assistant noted the roll:

HF 588 (Atkins) - Hospital staffing report required, and study on nurse staffing levels and patient outcomes required.

Chair Huntley moved HF 588 be recommended to pass and re-referred to the committee on Ways and Means.

Representative Atkins gave a brief overview of the bill. Representative Liebling moved adoption of the H0588A20 amendment. Following discussion the motion prevailed.

Discussion occurred on the H0588A21 and H0588A22 amendments.

The Chair renewed his motion that HF 558, as amended, be recommended to pass and referred to the committee on Ways and Means.

HF 950 (Nelson) - Family child care providers and individual providers of direct support services collective bargaining authorized, and Quality Self-Directed Services Workforce created.

Representative Nelson explained his bill. Testifying were:

The Chair announced the agenda would be continued at 6:00 p.m. in the Basement Hearing Room and recessed at approximately 11:45 a.m.

At 6:11 p.m. Chair Huntley called the meeting back to order in the Basement Hearing Room.

Representative Dean moved adoption of and explained the H0950A51 amendment. Discussion occurred and Julie Bleyhl, AFSCME Council 5, testified briefly. Representative Zerwas called for a roll call vote on the A0950A51 amendment which failed 11 to 9 as follows:

Ayes: Norton, Abeler, Dean, Gruenhagen, Mack, McDonald, Quam, Schomacker, Zerwas
Nays: Huntley, Allen, Fischer, Fritz, Halverson, Hortman, Laine, Liebling, Loeffler, Moran, Newton

Representative Norton moved adoption of the H0950A53 amendment. Discussion followed. Eric Lehto, Chief of Staff, AFSCME Council 5 testified briefly. Representative Zerwas requested a roll call vote on the H0950A53 amendment but first moved adoption of an oral amendment to the H0950A53 amendment as follows and requested a roll call vote on his oral amendment:

Line 1.5, delete "ten" and insert "fifteen"
Line 1.10, delete "ten" and insert "fifteen"

The oral amendment failed 9 to 11 on a roll call vote as follows:

Ayes: Abeler, Dean, Gruenhagen, Liebling, Mack, McDonald, Quam, Schomacker, Zerwas
Nays: Huntley, Norton, Allen, Fischer, Fritz, Halverson, Hortman, Laine, Loeffler, Moran, Newton

A roll call vote on adoption of the H0950A53 amendment was taken which failed 11 to 10 as follows:

Ayes: Norton, Abeler, Dean, Gruenhagen, Mack, McDonald, Quam, Schomacker, Zerwas
Nays: Huntley, Allen, Fischer, Fritz, Halverson, Hortman, Laine, Liebling, Loeffler, Moran, Newton

Representative McDonald moved adoption of the H0950A63
Ayes: Norton, Abeler, Dean, Gruenhagen, Mack, McDonald, Quam, Schomacker, Zerwas
Nays: Huntley, Allen, Fischer, Fritz, Halverson, Hortman, Laine, Liebling, Loeffler, Moran, Newton

Representative McDonald moved adoption of the
H0950A66 amendment. Representative Hortman moved adoption of an oral amendment to the H0950A66 amendment as follows:

Delete lines 1.5 through 1.7

The motion prevailed. The oral amendment was adopted. The motion prevailed on the adoption of the H0950A66 amendment, as amended.

Representative McDonald moved adoption of the H0950A70

Alex Bartolic, Department of Human Services

The motion to adopt the H0950A70 amendment did not prevail on a roll call of 12 to 8 as follows:

Ayes: Abeler, Dean, Gruenhagen, Mack, McDonald, Quam, Schomacker, Zerwas
Nays: Huntley, Norton, Allen, Fischer, Fritz, Halverson, Hortman, Laine, Liebling, Loeffler, Moran, Newton

Representative Mack moved adoption of the

Representative Moran moved adoption of the
H1142A4 amendment. The motion prevailed. The H1142A4 amendment was adopted. Rep. Moran continued her overview of the bill, as amended. Phily Auclaire, PhD and Resource Director, Spectrum Mental Health, Minneapolis, testified.

Representative Moran moved adoption of an oral amendment as follows:

Delete Section 9 and renumber sections accordingly.

The motion prevailed. Chair Huntley laid the bill over, as amended, for possible inclusion in the Health and Human Services omnibus bill.

HF 362 (Halverson) - MFIP child care assistance modified.

Matt Burdick, NAMI-MN testified and following discussion, Chair Huntley laid the bill over for possible inclusion in the Health and Human Services omnibus bill.

HF 430 (Hortman) - Family economic security act created, minimum wage rate increased, child care assistance modified, new child care tax credit provided, working family tax credit expanded, and money appropriated.

Representative Hortman moved HF 430 be recommended to pass and laid over for possible inclusion in the Health and Human Services omnibus bill. Testifying were:

Alexandra Fitzsimmons, Legislative Affairs and Advocacy Director, Children's Defense Fund

Following discussion, Chair Huntley laid the bill over for possible inclusion in the Health and Human Services omnibus bill.

HF 1114 (Abeler) - Licensing data, human services licensing, child care programs, financial fraud and abuse investigations, and vendors of chemical dependency treatment services, fair hearings, and health-related licensing boards provisions modified.

Representative Abeler moved HF 1114 be recommended to pass and further moved adoption of the H1114A8 amendment. Jerry Kerber, Inspector General, Department of Human Services, testified throughout discussion of the incorporated amendments.

Discussion followed and Representative Abeler moved adoption of the H1114A6 amendment, incorporating an oral amendment to the A1114A6 by Representative Loeffler as follows:

Line 1.17, after the semicolon delete "and"
Line 1.18, before the period insert "after "directions" insert "; and

(6) the product does not include triclosan or derivatives of triclosan"

The motion prevailed, the H1114A8 amendment, as amended, was adopted.

Representative Abeler moved to further amend the H1114A8 amendment by incorporating the language of the H1114A7 amendment. The motion prevailed.

Representative Abeler moved the H1114A10 amendment be incorporated into the H1114A8 amendment, as amended. The motion prevailed.

Representative Abeler moved adoption of the H1114A9 amendment. Following discussion Representative Abeler withdrew the amendment and indicated he would work with Representative Loeffler on this language.

Discussion followed of HF 1114, as amended. Representative Abeler renewed his motion that HF 1114, as amended, be recommended to pass. The motion prevailed.

Chair Huntley adjourned the meeting at 9:48 p.m.
